If I own two houses, live in one that is worth less than I owe on it, can I claim the other as exempt? It's only worth 17k but if I can exempt it I can sell it later. Main reason is I don't want this to drag out while the trustee tries to sell the house. If I surrender does the case remain open until the house is sold or once surrendered would and no other assets would that close the case?

How did it workout with your two houses? I am in the same situation, where if possible we would like to save both houses? Did they allow you to keep them? under 7 or 13? Did you have to prove that you can make payments on them, if you were behind before?

i'm filing 7. I am letting my homestead go to foreclosure. My other house worth 17k I will be able to keep under the federal wildcard exemption. Have an attorney go over it with you.
