    Ford Motor

    Did anyone have to deal with Ford Motor regards to a reaffiirmation agreement? We received paperwork from our attorney that Ford sent to him to reaffirm our vechicle. Our attorney said in his letter if we want to keep the vechicle we should return the reaffirmation agreement to the creditor. However; he will not sign his part of the agreement since we show a negative on our budget. We can and have been making these payments with no problem.

    In part of the agreement, there is a section "debtor's statement in support of reaffirmation agreement' where we have to show our take home pay vs monthly expenses. Should we show what was submitted on the bankruptcy petition? Should we even sign and return this agreement? We want and need to keep this vechicle.

    Any advice would be appreciated. Just a little confused on what to do with this one and my attorney is out of the country for the next week.

    My wife has a lease through FMC which she reaffirmed, but there was nothing about "take home pay vs monthly expenses. It might be a little difficult seeing as your lawyer is not willing to sign it (doesn't make sense, you're paying him/her), but I'd contact them and just let them (FMC) know you want to reaffirm.

      Many lawyers and judges are unwilling to sign reaffirmation agreements. Remember by signing it they are also affirming that it will not put an undue strain on you. It hasn't been tested in court but it is felt that if they sign it and you fail to live up to it they could be held accountable that's why most are unwilling.

      Do you know if they'd allow a ride through?
