            I'm sorry AngelinaCat, I've been a little busy the past few days and didn't see this.

            Yes, the trustee meeting is the 341. Each BK case has a discharge and a closing. Most trustees will grant a discharge to people and almost immediately close it. Sometimes there are outside things (such as the stimulus check in our case) that the trustee wants to wait on before closing the case. If he keeps the case discharged but open, he can "come after us" if we don't surrender the check like we are supposed to. But in reality, getting the discharge is just as good as it being 100% over.

            Every case is different. Honestly, if your trustee didn't specifically say that he/she wants your tax return/stimulus check, then you have to wait and see. Obviously you have other immediate issues at hand (adversarial action), and are still waiting to finish your taxes. IMHO, I'd keep your head down, don't mention it, and if all else goes fine, the trustee might just discharge and close your case long before you get either refunds.

            Well, I can't tell you what to do, but in a sense, when you entered into a contract and either paid the retainer or paid in full, you've paid the right to ask the attorney these questions. Now, many times things like this (questions) might be handled through a paralegal or assistant, but in the end, you paid for their services, and unless they specifically stipulated that this was going to be a "paperwork only - no other support" arrangement, you have every right to contact and ask questions.

            In the end, if things go wrong, who is going to get pounded on by the trustee? Not your lawyer, you and hubby are. Gotta look out for yourself girl! I'll help in any other way I can. Good luck!
