    File before or after stimulus??

    Hello,

    After watching the board nightly for several months, I have finally have built up the courage to hire an attorney, and they are in the process of building my case. I am wondering if filing before May is advantageous, because the trustee may not take my 08 tax refund. However, if I file after May 2nd, I can spend my stimulus before filling. Anyone have thoughts on this?? Could I be walking a dangerous line here? Thanks as always.

    The most conservative move would be to file AFTER you receive the stimulus.

      My attorney exempted my 2007 tax return and says I should get to keep the stimulus. I don't understand why people are losing their return. She also exempted our bank account. I guess we have fewer assets than others???

      In answer to your question, if you can wait to file, I would.

        Whether or not you can exempt your tax refund and/or stimulus largely depends on what state you live in (a handful of states allow you to choose between federal and state exemptions) and whether or not you have equity in your house that you are trying to protect

          My state (Kansas) does not have any such exemptions on Tax returns I am wondering at what point does the trustee consider taking taxes in the calander year?
