I am filing bk on my credit cards and i have a rental property that will be going also.My question is that on the rental property my wifes name is only on title not on the loan so that would mean that she is not responsible for the debt correct? From what i thought is that in michigan the spouse has to be on title but are not responsible for the loan

Since Michigan is not a community property state, if your name is the only one on your rental property mortgage, then your wife can't be held responsible for the unpaid mortgage debt if you file Ch 7 and surrender the rental property.Originally posted by motox View PostI am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
