    Question about 341/PACER status....

    Okay....I am getting nervous. I have been losing sleep and feeling awful due to this whole thing. I'm sure most of you can relate.

    Here's the scoop....I had my 341 on 4/23/08 and the trustee asked for 2007 returns and pay stubs. Well, I had everything else, but 2007 returns were given to my atty., which he said they sent to the trustee. Anyway, my fault....I will have everything next time (was hoping there wouldn't be a next time). The trustee set a continuance for 5/15/08. My atty. assured me I wouldn't have to return as long as the docs. were sent to the trustee. Well, the returns and the pay stubs were sent to them on 4/28/08. However, my PACER status still indicates....Awaiting 341, 341 terminated, continuance on 5/15/08. I called my atty., who then called the trustee, but still hasn't gotten back with me. His legal asst. said she was still awaiting a return call from the trustee's ofc. yesterday. Any thoughts on this? If I have to re-appear, so be it, I guess. I do have special circumstances since my 5 yo daughter is disabled/tube fed. This makes it extremely difficult to get to the court building. Anyway, I just want this dine and don't know why it would be necessary to appear if they have what they need

    Don't worry about it. The continuance of the 341 is known as "For Reporting Purposes Only" under your circumstances. Once the Trustee has what he requested, he will put a PACER note in that the meeting was "Concluded". It may take a few days to a couple of weeks before he makes that entry, but it will happen. In any event, you would not need to attend another meeting, under the circumstances you have outlined.

      I wonder why the atty. is double checking on this. Hmmm....Cannot wait for all of this to be done. I keep calling his legal asst. and she is wondering why it's a problem for me to reappear. I thought this was a no brainer; who wants to keep going to court?!!?
