Has anyone had Rooms 2 Go Repossess?

One of our creditors is Rooms 2 Go. We purchased a dresser and bed for my daughter. The bed was purchased over a year ago and the dresser in January. One attorney told me we couldn't pay the card, because it would be a preferential payment. We could reaffirm the card after the BK or bluff and see if they come for the furniture. I would hate to bluff and get the furniture taken away.

The other attorney I met with said I could pay off that debt because it's considered a secured asset since I purchased it with the store's credit card and not just any mastercard of visa. She also said I could chance it and see if they come get it.

I would really prefer not to chance it. I would prefer to pay it off not, with my tax refund.

I see one more attorney on Monday and will hopefully make a decision.

Just wanted to know if anyone had any similar situations

It depends largely, DELL never came after my computer. Used furniture doesn't have the same value as new furniture, its not as significant drop as electronics but assuming its not antique you most likely owe more on it than it is worth.

I can't tell you for sure if they'll come get it or not though.

I bk'd Rooms to Go and Havertys and neither one came after my furniture. I said that I would surrender in all paperwork and nothing - not even a letter from them. I guess technically they could come after it at any time but I haven't heard a peep and frankly, if they want it, they can come and get it - for all the debt that I got to get rid of, I'd happily give that stuff back.

Also - even though I applied for a Rooms to Go credit card, it was backed by Citibank so all the bills came from Citi - not sure if this is why they didn't come after the stuff. My stuff was about a year and a half old when I filed. I don't even think I made any payments other than the initial down payment. I had something like 1 year no interest no payments and when I bought it I was still married and then 4 months later my life turned upside down when I left my ex. Never thought I'd be filing when I bought all the stuff.
