    341 Next Monday....reaffirm agreement..

    Our 341 meeting is next monday. When I origionally filed chapter 7 we intended to stay in our home and checked affirm for our mortgage and a line of credit from a different bank.

    We recieved a reaffirm agreement from laywer of bank with 32k equity line of credit. But we got behind on house payment and decided we will let it go and not reaffirm. Should I tell the trustee this? Will it screw up or delay the process? Can the bank go after us if we don't reaffirm? The house is worth less than the total debts on it.

    Your statement of intentions is just that-intentions. It does not count unless you sign and the reaffirmation agreement is filed. If you don'r eaffirm, you have no liability.
    Just tell the trustee you've changed your mind-will not affect your filing.
    You and your lawyer may need to adjust your expenses to reflect rent payment.
