    Can I use my Gas Card?

    Hello,

    In preparation for BK I have stopped using all of my credit cards, etc. I was wondering though, is it okay to use a gas card if I pay it off in full each month and don't carry a balance on it? It's mainly for the convenience, so that I can full my tank and not having to pre-pay every time.

    Will that be treated as "preferential payment"? And if yes, does that impact me in any negative way during the BK?

    Well I wouldn't use it now unless you absolutely had to. The card most likely will not survive the bankruptcy so its better to get used to not having it than putting it off.

    To qualify as a preferential payment I think you have to have paid them over 600 dollars in the last 3 months.

    All preferential payment does is that it determines you paid one company to much, while not paying others. The Trustee can go back and claim some of that money to be distributed among all debtors, you'd thus need to include the card in the bk even if it has a 0 balance at the time of filing so that you can absolve any responsibility.

      But why risk causing potential problems with a forthcoming bankruptcy over a little "inconvenience"? Do you have a check debit card (or the version that
      has a visa/mastercard logo) that you could use instead? If not, I highly recommend getting one.

        Yea, thought about it further and also realized that using a Check Card would accomplish nearly the same thing, so that's what I'll do.
