    341 meeting today...now what?

    We had our 341 meeting this morning and I think it went pretty well. Our lawyer was unable to be there, so her boss came in her place but seemed to know our case pretty well. A few people before us had a pretty rough time, I felt so bad for them.

    I was prepared to answer many questions about the business I own (I own a direct sales company) but the trustee never mentioned it.

    The only issue he had was with a bank statement and our stimulus refund. We got the refund for $1800 on Friday and withdrew it from the bank along with hubby's paycheck. That showed up as a $2500 withdrawl. We filed the following Monday. He asked twice what the $2500 withdrawl was and how we spent it. I don't think he liked it much that we used $600 of it to buy a vehicle and the rest to catch up on bills but he didn't grill us about anything else. (we only had one and hubby needed to one to drive to work, we did ask our lawyer prior to buying it)

    If you spend your stimulus refund close to filing, KEEP YOUR RECIEPTS to show what you spent it on. We watched 11 couples before us, and every single one of them had to account for every penny of it. (In KS)

    My question is, what happens now? Do we have to do anything else (besides the post filing course), or are we just waiting on the discharge? How long before the discharge?

    Glad it went well for you. I don't know what your means test looks like, but if you had above median income and a lot of unsecured debt you may want to watch PACER to be sure you've gone under the U.S. Trustee's radar. They have 10 days from your 341 hearing to file a statement of presumed abuse. If this doesn't happen and your status is "awaiting discharge" you're well on your way and creditors have 60 days to object (and you are a member of the 60 day club).

      We were well below the median income and I think our total debt was around $100k ($25k multiplied by all the seperate collection companies the debts were sent to)

      I did register for PACER last month, but never could figure it out. I never did make it in to where I could view anything regarding our case.

        What does statement of presumed abuse mean? I haven't ever heard of that one!

          I have been monitoring our credit since the day we filed and working towards correcting everything on it, it has gone up about 100 points on each of the 3 already!! We are both back under fair in the rating rather than poor.

          We also found out we are expecting our third child last week, so life seems to be looking up for us!

          We will have our vehicle and the one loan we are keeping (co-signed by my dad) both paid off in November and should be well on our way to being back on track by January. We will only have our mortgage payment, utilities etc then!

          Thanks for the many months of support from this forum, it has been so wondeful. I hope to be helpful in the future.

            I am glad you haven't heard of it and likely won't since you're below the median. Above median filers have to take the means test and if it shows (in a sick, contorted, unfair way) that you had a certain amount of disposable income in the six months prior to filing, every effort is made to kick you out of a Ch. 7 and into a Ch. 13 or to dismiss your case altogether. It is rare for the UST to file a statement of presumed abuse in a below median case, but it does happen. I'd give PACER another try so you can have that peace of mind that comes with knowing things are proceeding as they should be. If you get stuck, we'll help you.

              We had our 341 on May 15th and received our stimulus May 16th. Our trustee didn't say one word about it. We even used our stimulus to pay for our daughter's tuition.

                THAT IS GREAT THAT CREDIT SCORE IS ON THE RISE. IF YOU DON'T MIND MY ASKING, WHAT WAS IT BEFORE? DID YOU DO ANYTHING TO HELP IT INCREASE 100 POINTS? AWESOME

                  We got a notice last week from the IRS, that our stimulus check of $1,200.00 was being credited toward the taxes we owe for 2007....... So that took care of that!

                  We would have sent it to the Trustee, but instead we will send a copy of this notice.
