I would say that it would be 1/1 to current date. If you file 7/17 for example, then figure 1/1 to the last paystub before you file. Some districts, trustees may ask for a longer period.
If I knew it all, would I be here??Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.
If I file 7/15, is my income calculated from 1/15 to 7/15 or 1/1 to 7/1?
Thanks.
For the means test? It is the average of the six month period ending on the last day of the month before filing, so it would be 1/1-6/30. Same with expenses. The only reason I know this is because the UST corrected our petition. We signed our petition a few days before the last day of the month and didn't know we needed to include the 3/31 pay stub. Yet another lesson learned...
Depends also how you get paid - weekly, bi-weekly semi-monthly or monthly. I filed on July 10, 2004. My paydays were the 15th and the last day of the month. My attorney just advised me to produce my last (June30) paystub, in addition to the ones before that.
