    Means Test & Schedules

    Tonight was the first time I actually looked at all the paperwork for my BK. When I signed my paperwork I really didn't look at everything, wasn't feeling well. I remember going over some expenses and I could have swore we ended up negative on the schedules.

    Well the schedules has us as being positive by 60$.

    I knew we were over on the median but I didn't know we were over by 23k.
    So as everyone knows if you are over median you have to do the full means test. We qualified for C7 because we were negative on Part D.

    This is why I would never file without an attorney.

    It is better to show a slight positive when comparing I to J than to show a big negative. My lawyer changed mine to be slightly positive by adjusting some numbers.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      I agree with JRScott. I think having a large negative number on schedule J when you're above median draws more scrutiny to your expenses.

        Thanks JR and Help, I never knew that.

        I really hope the UST doesn't give me grief about the large amount of debt we have.

        So far no creditors have said or done anything. I have my 341 in less than 2 weeks.

          Cali, I'm thinking its the trustee that probably should be worried and not vice-versa. I have no doubt you'll do just fine.

              I agree. I'm sure in most cases the UST shows up to a hearing like ours, the debtors are completely clueless (like we were) and just get trounced (like we did). I'll bet it shocks them when the debtor actually knows what they're about and what's going on.
