    Debtor Pre-Counseling VS Debtor Education

    Of course, I have one of my brilliant questions and it's after hours again!

    Do lawyers expect that you do the precounseling on your own, outside of their office, before you file?

    My lawyer is charging $100 for Debt Ed. but I forgot to ask if it includes the Pre-Filing Counseling.

    Do most lawyers include both when they do require you to do it through them?

    You have to complete a pre before filing and post before discharge (I'm not exactly sure when you complete the post, haven't gotten that far yet). It is $50 for each course.

      Post is completed right before your discharge.

      Our's is $50 per course.
      May 2008 Hired 1st Attorney/Stopped paying CCs
      May 21, 2009 Retained 2nd Attorney
      May 28th - Filed for Ch 7 (FINALLY!)
      9/11/09 - DISCHARGED!!!!

        Both our counseling was included with attorney fees. I did pre before filing and after filing my attorney suggested I do the post before my 341.

            Actually ijn most courts you can do the required post-filing consumer ed course anytime between your 341 meeting and your discharge. Some courts have a custom that all their filers must do the course within 45 days of discharge. Your lawyer (or the bk court clerk if you filed on your own) can tell you what to do in your location.

            It's best not to put the post-filing course off until the last minute because your case can be dismissed if your discharge comes and your post-filing course completion certificate isn't filed with the court.
