    Bankruptcy Chapter 7

    I filed pro se.

    I had a discharge of Debtors on April 7, 2008. I had a personal injury case pending, which was disclosed on my filing paperwork. It was pending during my bankruptcy closing procedure.

    Now, I am due (more than likely) to recieve a $100 settlement, on July 17, 2008. Can the trustee garnish the total amount of my bankruptcy with an Adversary action? By the time of my hearing, it will have been well over 100 days since my discharge.

    And, how due they monitor this?

    Since it was an asset of the estate within 180 days of filing, they can snatch it unless you have exemptions to cover it.
    They'll find out eventually by just checking public records unless, opposing attorney notifies the trustee. That does happen frequently. They'll notify the trustee and off er to settle for the balance of the bk if that's a lower number than they could potentially lose in the lawsuit.
    I assume you mean $100K and not $100.
