Well we had our 341 this past tuesday July 8th. Was a piece of cake. Nothing like I had feared. We are over the median by $13K. We had $7500 prepaid rent listed (for our rental...surrenderring house). The trustee addressed the attorney and said that the $7500 was listed in the wrong place on the petition and that there is a provision which allows up to 6 months prepaid rent and suggested he get that amended so the US trustee wouldn't come after that money.
Well today...there is a "pending status" on pacer that says "awaiting closing" and goes on to say..
Report of No Distribution
Trustee Report of No Distribution. I have been duly appointed trustee of this estate and report that I have neither received any property nor paid any money on account of this estate; that I have made diligent inquiry into the financial affairs of the debtor(s) and location of property belonging to the estate; and that there is no property for distribution from the estate over and above that exempted by law or that has been abandoned pursuant to the provisions of 11 USC 554 or 725. Pursuant to FRBP 5009, I hereby certify that this estate has been fully administered. I request that this report be approved and that I be discharged from any further duties as trustee.
Okay...so is this looking as good as I think it is? When or how does a US trustee get involved if they are going to? Any thoughts?
