    Tales from the 341

    We had two 341 hearings. In the first hearing, the UST showed up, pointed out some errors in our statement of financial affairs (we had listed the wrong years for our previous two years income), asked about our child care expense on the means test (we are over median but by actual expenses are safely out of the presumption of abuse), then he was done. The regular trustee then badgered us about our cars, among other things, then continued the 341 since we filed our schedules 15 days after our petition (as allowed by the law and local rules). Since the UST was there, we went first and didn't see anybody else's hearing.

    At the next 341 hearing, I guess the UST lost interest in us since we got to sit through the hearings of everybody who had an attorney. For what it's worth, I wouldn't pay any of the attorneys we saw bupkiss. Some showed up late, which meant that their clients went to the end of the line (well, before us pro se losers but after the other represented parties). Some clearly had never looked at the filing before they showed up in court.

    For one couple, who used a Spanish interpreter, the trustee was asking about mortgages totally $700k when the only property listed was worth $250k. Turns out there was another property which they owned, which they refinanced with a lot of cash out. Then the trustee finds out that $60k of that went to buy a lot in Mexico that they still own! I think this is not going to end well for that couple (and I'd be curious to see what happens to the attorney).

    Anyway, for most of the people the trustee basically asked name, rank, and serial number, then said "good luck" and that was it. When he got to us, he just asked if we did everything the UST asked us (actually, only the regular trustee had really asked us to do anything, but nevermind), said "good luck," and that was it. Maybe the first time he was just showing off for the UST. Anyway, the next day pacer showed the Trustee's finding of no assets and no distribution, so we seem to be well into the 60 day club!

    Congratulations! I was a pro se filer and our 341 was interesting as well! We managed to make it with only one, but ther's nothing wrong with two as long as they turn out alright!
