    ? about surrendering vehicle

    OK so I surrendered mine last month and I was under the impression the difference of what I owe and what it sells for is discharged with the BK....A friend of mine who filed some years ago is telling me I will be responsible for the difference because she was ! Which is it ?????? Now I'm stressed out about it and need to know Thanks !!

    The difference is an unsecured debt, so it's dischargeable in bk. I'm a newbie, but I'm sure someone will come along and chime in...
    May 2008 Hired 1st Attorney/Stopped paying CCs
    May 21, 2009 Retained 2nd Attorney
    May 28th - Filed for Ch 7 (FINALLY!)
    9/11/09 - DISCHARGED!!!!

      My Lawyer just told me the same thing once you turn it in the debt is no longer secured. and it will be discharged with the BK.
      Any idea how long before the want the car back I skped 2 payments so far.?

        Thanks you guys I feel much better now because that's what I thought.

        TEW I missed 2 payments before voluntary surrendering it. The creditor filed for the stay to be lifted right before I turned it in.
