            Hi Jane: Perhaps I can give a little perspective, example shoes. We all have to have them. Many people have regular sized feet that when they go into the closest Payless or Wal*Mart and buy a pair of shoes for under $50.00. I am not talking about the 'designer' or 'kewl' shoes that the teens insist they have to have today. I'm talking about everyday functional shoes.

            I, on the other hand have a long, narrow foot that has never been esy to fit. [10 4-A, 6-A Heel]. Even as a child, we had to go out of town to the big city to find shoes for me, and I still do. My shoe bills are routinely over $100.00 per pair. I have found a place, still out of town, that I can find reasonably fitting and functional shoes that periodically offers a 'Customer Appreciation Week' where the products are 10% off. When we have the money, I try to take advantage of that. Sadly, one of those just passed, and I could not take advantage of it. Oh well, this too shall pass....

                Not even her gdaughter....how about those "nice people" on the boat who enabled her to "relive her wonderful memories" and probably spent millions of dollars looking for that necklace??!!!?? Geeshhhhh!

                    I'm glad you asked the original question though - I struggle daily with "do I really need this?" Too bad justifying is not a career or I would be rich rich rich. I have no idea what a trustee will think, but most of what you listed sounded like necessities to me. We also do not have a boat or anything like that but we spend so much on eating out. I'm trying to stop but its become such a habit....
                    I was once addicted to Starbucks (Mocha Lite Frappachino) but now if I need a pick me up - I head to McD's for Sugar Free Iced Coffee. Its like less than $2.50 for a HUGE cup.

                        Generally speaking neccecity (spelling) is relative, but I am sure that the court just means anything within reason. Im gonna steal one from BKparalegals book here and say your overthinking it (even though I just got on his/her case about this). While there is no clear ldelineation I think "luxury" would be something that any reasonable person would consider "luxury", we all agree a fur coat (real) would fall in this category, so just use common sense and if you cant decide then its simply not luxury.

                        The true difference between luxury and neccecity (sp) is rationalization.
                        Not only am I not a lawyer, the California BAR association has sent me numerous letters telling me not to even THINK about going to law school. In fact, the lay advice I provide is not even good. In the end remember, you get what you pay for, and here in BK land were not the best at paying.

                                You could form one heck of a debate over this subject. But it is really very, very simple. Necessities in life are items that you need to survive on a daily basis, and to me that would include items that you need to keep your job and your family alive and healthy, incliuding medical insurance and things of that nature.

                                Luxuries are items you don't need and can live without and would be something of an excess. i.e., do you really need the Lexus over the more economical car to get to work or do you really need those designer high heels in the office over the cute pair at the shoe discount store.

                                Some people absolutely have to have that Starbucks everyday and just cannot drink coffee made at home. Is that a luxury or a habit? You can't dissect everything so you just have to be practical about things as to your own situation.
