    341 was today

    Well, our 341 was today and overall it went very well. We had one creditor show up and I damn near had a heart attack in the court room. American General showed up asking what we planned to do about our loan with them. I had completely forgotten that it was a secured loan with our 2 laptops. Well the one laptop is long gone as the motherboard go fried and it wasn't worth it to replace it. He seemed upset that I got rid of it. What did he expect me to do with it? Use it as a coaster?!?! Then he asked if we wanted to keep the other laptop. Well, let's see it's a 6 year old laptop that is worth about $150 on ebay on a good day and the loan balance is $980. But he was so nice and said he could make a deal and we could only pay $500. I told him I could get a brand new dell for $600. He said, "So I guess you want to surrender it then?" Well, Duh!!! He asked for my address and phone # but neither I nor my lawyer think they will call.

    Afer that we went back into the main room and a few minutes later we were called up. The trustee asked us a few questions mostly about if we had listed everything, understood everything and other basic questions. No issues about the different last names, never even mentioned. Then he asked us about a house we had sold about 15 months ago and what we had done with the 18K we got from it. We had a garnishment for a judgement against me and also paid a bunch of bills with most of the money. He asked if we had borrowed any money from family and paid them back and we hadn't. And then we were done. No questions about changes in income which I was a little worried about since hubby had a bit of overtime recently. We were up there for 5 minutes tops. The UST was there for a few cases before us but not at the table when we were up there. We then went into the hallway and reaffirmed our car loans. We have a bit of equity, almost paid off and they are local so it wouldn't be hard for them to repo.

    Overall, it wasn't as bad as I thought it would be. I was pretty nervous and went to the bathroom about 5 times in the 1.5 hours we were there.

    I decided to check Pacer earlier and I almost fell out of my chair. The trustee has already entered his report of no distribution and our status is awaiting closing! So now the waiting begins and I am not a patient person but at least I can relax a little now and breathe.

        May 28th - Filed for Ch 7 (FINALLY!)
        9/11/09 - DISCHARGED!!!!

                  Thanks everyone. I did have a copy of the marriage license with me just in case. I figured if I didn't bring it, sure enough they would ask for it.

                  They may not have gutted me but you almost couldn't tell by the way my tummy was acting.

                  The first case they called and were talking about had major fraud involved and it didn't help my nerves one bit. It was continued until next week but the talk about criminal charges, embezzlement and investment fraud does not soothe a girls nerves. About half the room cleared out after it was announced that it was continued. Hell, there was even press there for that case! I got the story from my lawyer after the 341 as he is representing one of the investors in his claim.

                  I did calm down by the time we were called as there were 4 cases called before us and they were pretty simple so that helped. I am just so glad the 341 is over! Now I need to get back to cleaning as my mother is coming for a 1 week visit tomorrow.

                    Not only am I not a lawyer, the California BAR association has sent me numerous letters telling me not to even THINK about going to law school. In fact, the lay advice I provide is not even good. In the end remember, you get what you pay for, and here in BK land were not the best at paying.

                        Could see how that could rattle you. When I saw the one "long" (more than ten min) case I was happy, that much less time to deal with me! I actually arrived two hours early and watched a bunch of cases, which was fun to be honest. Maybe we should all (the forum members) take a trip together and go watch 341's and "remember the good old times" after were all discharged.
