Now that I am not paying the cc anymore i have extra money to spend so we go out to dinner and when i say out to diner i don't mean alot of money. for a family of 4 maybe 40.00. Will the trustee be pissed when they see that? Or should i just pay cash for the diner instead of using my debit/visa card? We aren't filing until sometime in sept or possibly oct.

I'm sure the gurus will correct me if I'm wrong, but I'm thinking you could claim that as part of your entertainment. Since it's something special you don't do everyday.
And it's not like you'll be buying $80 lobster dinners.

This is how our attorney told us to classify this. So I guess that's ok. Like someone else said, nothing wrong with a little enjoyment even when you're in the middle of BK. I do know what you mean, we went to McDonalds, yes we have kids and besides I like it too and I almost felt guilty until our attorney said it's ok. You know this might be silly but if we skip "nicer" restaurants and go to McDonalds we can actually eat out once a week. We have a 10% discount card and we can have double cheeseburgers for .90, not bad! My advice: If you go to a nice restaurant for whatever reason, be sensible. My daughter turned 9 today and she wanted to go to Olive Garden. (BIG $$$$ for us right now) We bought her and her little brother kid's meals, my DH and I split a meal for under $10. She got a free sundae (and a song
), and they brought my son one just to be nice.
Free salad/ breadsticks. So, no big expense, but big fun all the same.

I've found the same thing, actually. My and my fiance's schedules are so different; I'm on a 7-5 schedule and he works 2nd or 3rd doing general contracting. Trust me when I say that no trustee is going to worry over $40. Enjoy yourselves, but I hope you also will put some $ aside every month to create an emergency fund.
