Quick question that maybe you can help me with. We filed and have a date for our 341. I have an auto debit taken out on the 15th of the month from Bank of America - if I call them to have them stop it do they have to now that I've filed? The account is not at a Bank of America bank.

Auto payment from checking account

It's not a loan. We had a credit card with Bank of America and we were trying to pay it off and the only way they would let us was through an auto debit from our checking account (We did this before we knew we were going to file). I gave them our bank info and they take out $275/month, but now that we've filed I wasn't sure if they could still legally take out the money. I didn't know if I should call and tell them about the bk.
Am I making sense?? I'm still a little overwhelmed with everything.

I got all confused. Now I see; I thought somehow a loan for an automobile was involved in this. I'm sorry.
Once you filed, the 'Suggestion of Bankruptcy' goes out to all of your creditors, including the holder of this CC, BOA. The automatic stay will kick in, and they should not touch that account again. But to be on the safe side, I would stop that autodraft. You may even have to actually close the account and open a new one, as another poster suggested. I know thats a pain, but better than having BOA 'accidentally' continuing the auto withdrawls. That's my thought right now. I'm sure some of the other members will have their suggestions.

I really can not close my checking account. I have IRS payments come out of it. It took month to get that setup right I jsut don't want to mess witht at again

We contacted B of A to cancel the automatic payments on our B of A signature loan which were set up to be withdrawn from our checking account. The following month, the payment was withdrawn TWICE on that day. This caused our checking account to be overdrawn. I immediately tried to log on to online banking, but our account was locked. When I finally reached someone in their customer service center by phone I was told that it must have been a "glitch" and that we should contact our bank to stop payment on the charge. So, I paid $25 to stop payment on the automatic debit and was charged $38 x 4 in overdraft charges for checks that came through that day.
Our mortgage lender also debited our account the month after we de-authorized the automatic payments. I'm sure B of A and Countrywide make innocent mistakes like these every day.

I also had one of those "special arrangements" with BOA before I filed in order to try and pay off their credit card. They will only "allow" these arrangements of you do auto-draft payments--but it's not like a continuous draft since it's only authorized for so many payments. So they say....
Anyhow, I called, gave them the bk casse info and the rep said she cancelled the payments and gave me a confirmation number for the transaction. I'll watch my bank account, of course, but the fact she gave me her name and the conf. # sounds pretty reasonable.
I guess I shall see what happens later this month.
