    What can creditors do?

    My plan was to file Chapter 7-filing single. I have already paid an attorney 1/2 of the required fee. We are struggling to come up with the rest of it though.

    Our house has a contract on it (short sale) and we close next month, so we will need to have deposit plus 1st months rent in a few weeks.

    My question is with no house to place a lien on and no paycheck for them to garnish what can the creditors do if I don't pay? Last payments were in January.

    Then it seems to me that you are 'judgement proof'. The creditors can go ahead and sue you and get a judgement against you. But if you have nothing that they can levy against, nor wages that they can garnish, then they can get nothing. The only problem is that the judgement will remain in place for a period of time, I believe 7 years, and the creditor can have it renewed twice more at the end of that time. That is 21 years. That means you will not be able to own anything in your own name as long as the judgement remains in place.
