Deadline for 2nd financial education class

Hi - When I did a forum search looking for the deadline to complete the 2nd BK financial class, I saw conflicting info. Some thought it was 45 days from the filing date, others thought it was 45 days fromt the 341 meeting.

According to the Official Form 23 from the Unites States Bankruptcy Court, under Filing Deadlines: "In a Chapter 7 case, file within 45 days of the first date set for the meeting of the creditors under 341 of the Bankruptcy Code.

The reason you are seeing conflicting info is that the bk law does not give a specific time when the 2nd financial management class has to be completed. It just says "after filing and before discharge".

Some states and some local courts have decided that they will enforce a specific Ch 7 timeline when the 2nd class needs to be done (usually within 45 days of filing).

You need to ask your lawyer if your state is one that has a deadline.

No matter what, the best idea is to complete the second class as quickly as you can afford it. No advantage at all to putting it off.

When it comes to the timeframe for finishing this course, IMO it's better finished earlier rather than later. Though later may be technically correct, attorneys are telling most of us to have them finished by the 341 because it gives the appearance of being diligent in fulfilling our part of the process, and that's what I wanted to convey to my trustee.

I did mine online thru AAA Personal Finance, it was only $15. I believe they cover all states, since this is approve by the US Trustees. (I got this in the mail, right before I was about to plunk down $50 for CCC's services). When complete, they email you a completion form in PDF form.
I just emailed it to my attorney. Done.

I agree -- completing it as early as possible is best. I was totally clueless about the timeframe, and my attorney didn't really help in that regards. I thought it was procedure to wait until the 341 meeting, and THEN do the class. I don't know why I thought that -- probably b/c I didn't know what the 2nd class was. I just thought that was the progression : 1st class, file, 341 meeting, 2nd class, discharge.

The fact that our 341 meeting was about 3 minutes long and the trustee didn't ask about the class kind of cemented it in my head.

All done now, though -- just keeping my fingers crossed during this 60 day period. We're almost half way through..............

Our class was provided in the attorney's fees...we got paperwork regarding the company (Greenpath, I believe) and an internet address to begin accessing the course.
