    I am filing Chapter 7 Bankruptcy and I wanted to know if you need to send in the forms or take them down to the US Courthouse? I have a simple bankruptcy and been advised to do this myself. I am very nervous but need to get it taken care of. Any advice.

    Nessy, I just did all the paperwork for my mom to file chap 7. I found some posts here about www.form7.com software, it's $35 and WELL worth it. I then hired a paralegal to look over everything to make sure it was in order, and she's going to have mom sign and then will send them into the court for us. (she also has to make 2 copies of the original).

    When I finally got ahold of the paralegal to see what she would charge for just looking them over, she said she only charges $125 to fill them out and file them. So she was only going to charge us like $25 -$50 to look at them and copy/file for us. That might be something you can look into?

    I found it to be VERY easy, and I am not concerned/worried at all, but then again, it's not MY bankruptcy. Also, everyone here has been so helpful, it's hard to worry. ;)

    Read everything you can, and if you have any questions, always ask. There are some great people here!

    About personally filing. I don't know if it's different in each state, but here in California, we can send them in. Call your local courthouse, it should say on the recording if you can send them or not. If not, ask a court clerk. I found the one in Sacramento to be VERY nice.

      Yes, usually you can file in person or by mail. I filed an emergency bankruptcy in person, but when I had to file the rest of the schedules, I had already started my new job, so I mailed them (Overnight through USPS so I could have a tracking number).

          You have to pay the registration fee of $35 in order to use/print the forms. I found a few posts here about it, and it was a huge blessing. Very easy to use for someone who doesn't know the first thing about BK!

            creditors holding unsecured claims

            Can you tell me about the unsecured priority claims? I do not understand what they are are asking for. Is this all the creditors that I have or are these just creditors that need to go in order. I have no assests or property and I do not have anyone holding claims. Do i skip this part? and go to unsecured claims? Also I have a garnishment coming out that I just got hit with, where do I address this issue at on the forms?

              I think I found out that the "priority claims" were things like lawsuits or things you were late on.. gosh, my memory is THAT bad. I just know I didn't fall into that category, so I didn't use it. I think I found some examples on the program.. maybe that's where I got the info?

              Garnishments didn't apply to us (my mom actually) either, so I didn't have to do that, so I don't have any info on it.
