    341 next week!

    I have my much awaited 341 on 8/23. If a creditor was planning to show up and contest anything, would there be any prior input in PACER or do they just show up?

    I have some credit that I opened 1-year ago, but have not used in the past 6-months. I had opened these new cards as balance transfers, to take advantage of the low-interest rates. In essence, it was not new credit, just shifted around. But, my lawyer has cautioned me that these creditors may object.

    that is a good ? annie, my meeting is also 8/23, i am so nervous, what state are you in? i am in s.c.

      Some creditors do not like getting "stuck" with balance transfers.... they could show up at 341 or object. More than likely they won't - lawyer just warned you though...
      You will not see anything on Pacer till after your 341 meeting....

        I just want to get this over with. We have been contemplating filing since April, so it has been a dragging for awhile. Whatever the outcome, I am very ready to move forward in life, and much wiser in many aspects. We've been living without credit for over six months now (which was really a change in mindset) and I have never felt more free, which is ironic in that we are much more restricted by how far cash will take us. It has brought me and my family closer and spending more time doing free stuff (going to parks, picnicing, etc.) and we've never been happier.

          When was the last time you did a balance transfer?

          Sometimes a creditor will file a Notice of Appearance before the 341 meeting, but they are not required to, so they can "just show up". But if your balance transfers were over 6 months ago, I wouldn't worry too much.

          Good luck, be honest, answer the questions directly and only answer the question asked. Many people at a 341 feel the need to explain or elaborate, you don't need to. You don't need to "justify" your bankruptcy. Depending on the questions the best answers are "yes" or "no".

            the last balance transfer was 9/2004.

              Yeah I wouldn't worry about that. My last balance transfers were in May so I am forced to file a ch13 in spite of 2 lawyers that told me I "should be ok in a 7". I don't think so! If they dispute anything you should bring all the mailings to court that keep sending balance transfer offers. I could wallpaper my house with all the convenience checks they keep mailing me to this very day.

                hhou812hh, yikes! I wrote out a check to myself for $6000 back in May and paid off two credit cards with it (actually, one was $3000 in overdraft protection at my bank). I am also filing a ch 7. Lawyer doesn't think this will be a problem. I also could wallpaper my house with the convenience checks and balance transfer offers. Do you really think I should hold onto them? My lawyer will actually file around October 5th.
