    Change of residency right before BK filing?

    I am getting ready to file for BK, probably Nov 1, and am planning to surrender my house. I am already partially moved out of my house and in with my BF, where I will be paying rent.

    Is this going to complicate the BK filing? I mean, knowing you are going to lose your house, you have to live SOMEWHERE and plan for that, so it seems like it is not unusual to be living somewhere other than the house you plan to surrender?

    I was planning to keep my home address as the old address until the BK is discharged, just to avoid confusion, since that is the address all my creditors have on file. Plus, I live there with just me and my son, and so it is just my income and expenses considered for the Ch 7 filing. If I use my new address and my BF, then his income gets tangled into it and it becomes more confusing.

    I guess there was no general question here, other than others experiences with moving right before or during filing. Keep old address or change it? Does new 'rent' amount become part of your filing criteria?

    Any advice or thoughts are welcome. I am getting a great general education from the forum, just a few things I am a little unclear about.

    i'm assuming that you are staying in the same state. otherwise you'll need to establish residency for 6 months before filing.

    The numbers you will need to use are the numbers for the day you file your paperwork. Is there anything stopping you from filing before you move? If you file after and your expenses drop significantly you may be looking into a 13 instead of a 7. Once your filed it doesn't matter what you do.

      Renting vs owning will also change your allowable exemptions, and all your expenses, so you may be better off to hold off the move until you've filed. Are you using an attorney? Definitely don't make the decision one way or another without asking advice on this issue, since it will change EVERYTHING.
