    Pissed Off

    I called the bk court and asked where the hell was my discharge letter that was due in July and the clerk told me that due to some new law anyone that filed after 4/20/05 may need to have a discharge hearing before they are discharged or something like that she said that it was nothing wrong with my case everything was fine with that but the judges have to get together to figure out what they can agree on as far as dischagre hearings she also said that everyone that has filed after 4/20/05 are experiencing the same problem
    she also told me that my discharge was due in july

    Can someone please give me some info on this if they know anything

      I sure hope you didn't ask them with that tone of voice. If so You won't see any discharge papers...

        I thought everyone knew about the discharge hearing. It's in the NOLO book on how to file a Ch 7 BK, in Chapter 4/page 11.

          Thats true there is always a discharge hearing. you just dont usually have to attend it. They are probably just backed up with all of the filings. I wouldn't panic at this point.

            It's another issue determined state-by-state. My atty said that New York State usually doesn't have them. Other states sometimes do.

                Anyone in California have this happen?

                My mom went to the paralegal to sign papers on Tuesday, and the paralegal mentioned TWO meetings. I told my mom, "NOOOO.. there's only ONE".. now I wonder if this is what she meant??

                  I honestly don't know. It depends on a jurisdictions local rules, but I can't imagine that there are jurisdications that still have discharge hearings, and there is nothing in the new law that I am aware of that suddenly requires the hearings after April 20, 2005.

                  I wouldn't worry about it unless you recieve notice of the hearing (like you have, or will, recieve notice of the 341 meeting, note--double check the 341 notice and see if its mentions a discharge hearing).
