    I feel so lost in Florida

    Here is the scoop, 30 grand in CC debt , Mortgage (HFC) has never been late and current, one loan(Wells Fargo) with a balance of 2900 dollars with my car title held as collateral a 2001 honda civic ex in fair condtion with NADA trade in value listed as 3500 . non exempt personal property , antiques, shotgun are the only real things of value I own. I am probably about 1,000.00 over the florida exemption for non exempt property.
    I work two part time jobs after losing my full time job 9 months ago , I am below the florida median income for the means testing. However for one job i am paid as in independent contractor cash.
    3 out of 4 lawyers saw no problem with reaffirming and keeping the car and reaffirming the mortgage but then one lawyer said the car would be IFFY, my friends say they will take the car LOL I guess my main concern is the car., I travel such a long distance to work i can NOT GO WITHOUT TRANSPORTATION.
    I also read that most like 97 percent of all chapter 7 cases are no asset cases and you can breeze through them and keep everything.
    ALso there is a pretrial hearing set for next week for one collector . How long can i wait till after that hearing to finish paying my attorney and file ? HELP WITH SCENARIOS PLEASEEEe

    You actually owe so little. Your 30k card is about all that you wish to release. Unless I am misreading you. You want your house and car, the Shotgun is not antique, it is old, REMEMBER THAT. It has little value. I would attempt to work out a situation with the 30k problem. You can nicely talk to them about an adjustment and mention you are considering C7 otherwise. Remember, “half of something is better than all of nothing”. Please reconsider bk, but you know more about your situation than I. More info could help. ‘Hub

      is the lawyer saying reaffirming the car is ify I would not just keep paying for it unless unless it's required by FL law that way if it turns to junk after you are discharged you take it to the nearest branch office. If the trustee take your stuff you may be able to buy it back from him. Why waste your time with the collector after you file that will be included and whipped out.
      pick a lawyer and file. good luck I am sure you will get more ideas here

          The problem is I am working two jobs Killing myself to get nowhere . I can barely buy groceries for myself and I am not even paying on any of the credit cards and have not in the last year. I now have pretrial hearing set for one creditor. The meanest one LHR and I am afraid the others will follow suit. I cant even afford the pay any settlements offered they are only offering me a 15 percent reduction in the balance. WHat about judgements and garnishments ?

              Welcome to the forum. First of all, please calm down, things are not as bad as they seem. My husband is also responding so you will get us as a 'double-whammy'. You are very similar to our situation. You may want to search on our nicknames, 'AngelinaCat' and 'AngelinaCatHub', for a more complete scenario.

              But to answer your last question first, if you have been served papers requiring you to appear in court, and have been sent to Mediation--that is what it is called--appear, and tell them that you are doing the best you can, but can do no more. Perhaps even offer a *token* payment of $50.00 a month--if you can afford it. All of this takes time to set up. Probably, the creditor will not accept the compromise, and the case will go to trial.

              Don't worry, it still takes time for the courts to process these things.

              You really need to purchase the nolopress.com C7 book. It is around 17.00 for the downloadable version, more if you buy the print version. You will still save about half the price of the book in a retail bookstore. It is intimidating reading, but for the most part is written in plain English. That will help to start answering your questions. Nolopress offers a freebie--take that too.

                  When you file that all judgments and garnishments stops........... 30 K may not seem like much to some but it can be a mountain to others.
                  have you pick the lawyer you like? can you work out getting the fee paid?

                      Kerry, please investigate and sign up for angelfoodministries.com. This is an outfit that provides food service for anyone--whether they be destitute or multi-millionaires. The food is of very good quality--though not gormet--and for about 1/2 what it costs to purchase food for a family of four for a month. Unfortunately, the order cut-off date for our area in Florida was today, October 13. You PURCHASE the packages. This is NOT a charity as such. And the personnel are encouraging more and more participation, because they buy in bulk--and the more they buy, the more the purchaser gets, hence the greater the savings.

                      Please check out the website and see where your local distribution area is. Perhaps you can squeeze in.

                        I have had 4 lawyer consultations 3 of them were the Flashy hippy no problem dude. WHy pay it back , be done with it move on, they all charged 1500 plus filing fees. THe 4th was a quiet laid back and spent an hour with me in my consultation and he is only charging 800 plus 400 filing fees. I will have enough money to pay him his fee then the 400 30 days later . Which i have scrounged by not buying myself the proper food I need for my health etc. for months now. I also expect maybe being laid off again soon . With no real jobs in sight. How on earth could i even pay back half without digging my grave deeper and Thankyou all for your comments and s upport. I have been through a very rough couple of years after my last GF crackhead tried to murder me.

                              I am curious about the $400 filing fees. It is $299 to file Ch.7 and $274 to file Ch. 13.
