my wife and i were discharged back in sept of 2006. at the time of filing we surrendered our house which had a 1st and 2nd mortgage. last month received a letter stating that the 2nd mortgage had been transfered to a differnt mortgage company.checked my credit report and sure enough it named the new mortgage company, and it stated that we were 180 days past due.how is this possible??what should we do?i contacted them when i received the letter,and they told me that they would check into it on their end.never got a call back exept a notice from the credit report agency.

Contact the new 2nd mortgage lien holder and send/fax them a copy of your discharge notice. I doubt you will get anywhere with the original 2nd mortgage lien holder since they have sold the loan. Then contact and dispute the debt with each CRA and indicate that this debt should be listed as IIBK, not 180 days past due.

Was there a judgment on that loan before your filed?
Something my lawyer told me to do after discharge was to get certified copies of my discharges. since my wife has 4 judgments agents her she said that have a way of popping back up. and you just send them a copy of the discharge.
