60 days is almost up... can this be extended longer?

Hi All.

Our 60 day mark since our 341 mtg is on 10/20/08. We got an email from our attorney today saying that our case is not yet closed and that the courts are very backed up right now. What does this mean?

Does this mean that our bk 7 will go on and on OR does it mean on 10/20/08 or around that date that we will be discharged?

We don't have any flags or any pending requests listed on pacer. It is very quiet.

Hi Whoops: If you are a no-asset 7, most likely your case will be discharged on the 20th. Your attorney is correct that a backlog may delay this.

Typically a C7 case will be Discharged first, then Closed later. The Discharge is the important order. That is the Order discharging all debts allowed. The Closure date will come later--sometime the same day, if a no asset case--but mostly several days or a couple of weeks later.

We are an Asset case and must make payments to the trustee until April 1, 2009. We were officially discharged on August 13, 2008, but our case will not close until sometime after April 1, 2009.

I hope this helps a bit to ease your mind.

Our district is VERY backed up. At our 341 meeting they told us and the people who went before us that their case would be discharged in 60-90 days, asset or non-asset.

Yes, the time to Discharge can be extended. I am at 4 months right now. My 341 was on 6/17/2008. It has been one problem after another.

UMMMM I would check to see whats going on with that. Do you have a pacer account. you need to check for flags holding it up.

For the original poster, our Discharge date was delayed almost 6 months because--of all things--there was no copy of our Marriage License in our paperwork. We had to bring a copy to our 341, and had copies to give to our trustee, but no, he didn't need it....... GRRRRR!!
