    how common is bankruptcy dismissal?

    so as for you that dont know I am helping my parents file through chapter 7 bankruptcy we have an attorney and are almost in the last stages of gathering paper work before filing. they are in almost 40k in debt and have none of the bills from the last 2 years because my dad hid all of this from my poor mother. the house runs on one income and no house or anything and the lawyer said it should be no problem for chapter 7


    But one thing he is worried about is that if my dad who is a nervous person will jump up and say the wrong thing at the 341 and the bankruptcy would be dismissed.

    and since we dont have any credit card bills for the last 2 years do you guys think this will be a problem with the trustee? they havent used any of the cards for the last 2 years. I dont know I'm just really nervous about their bankruptcy going through bec I'm really scared of reading about bankruptcy dismissal and audits people have been writing on this forum about...

    Your father's credit reports will list everything you and the attorney need to know. Also, the bank that he was using to pay his bills in the past would have recorded records of what went in and out of his checking account, check copies, etc. With that information you can contact each creditor and get a copy of what is due and owing, account numbers, etc. I don't see any problem that you would have to worry about as to a dismissal. The attorney will be there and will have things under control. Voice your fears to the attorney. Your parents' attorney will get them through this and I commend you for taking the time to help them and ensure all gets done. When this is all over your major worry is ensuring your dad doesn't end up doing the same thing several years down the road.

      Sorry but I have to ask. Why I am not sure of the age of your parents. Is your father still working? Can they garnish his pay? Retirement or social security creditor can touch them. No house
      Sorry if this offends you I don’t mean to but maybe think about putting them through this.

        my parents are 48 and 47...and my dad is not employed and hasnt been since January the lawyer said it wouldn't be a good idea to get a job.

          Well: You just blew my idea of perhaps one or the other is mentally incompetent. The only advice I could give is have your Dad prepped to keep his mouth shut at any 341 or other. Sounds like you have your hands full. If they are truly C7 candidates, the lawyer will know. However if Dad “ goes off” in the presence of ANYONE, it would quash anything you are trying to help him in. Please from another Dad may I say; “to thien ownself be true”. Do not let parent problems harm your own self or family. ‘Hub
