    What can lawyers do?

    Hello,
If you are trying to file for chapter 7 and it has to be put on hold for a few months can a lawyer help hold off creditors or try to work with them until bk can be filed?
Basically, I am filing chapter 7 but have to wait a few months to get some stuff cleared up. The lawywer has been paid in full. I talked about the creditors calling alot through out hte day and he keeps saying that I should give them his name and number.
Shouldn't he being sending letters and things for me?

I live in pa. Thanks for any guidance.

All you have to do is give the CA the attorney name and phone number. Don't answer the rest of their questions. They may or may not call your attorney, but it will slow down the number of calls you receive tremendously.
    Filed CH 7 9/30/2008
    Discharged Jan 5, 2009! Closed Jan 18, 2009

I am not an attorney. None of my advice is legal advice in any way..

Hi xray: You paid your lawyer to take the heat for you. Give all your callers your Attorney's contact info and let his/her office handle it. Ideally, the reason one hires an attorney in the FIRST place is to have someone else do the worrying FOR you. Sadly, that doesn't always happen.

      Good luck.

PS: You don't need to keep signing your name. and if it is anything close to your real name, I advise against it strongly. 'Hub and I are victims of a cyberstalker, via another chat room/forum.

Why even tell them you have an attorney? That's letting them know you are planning something, and it may hasten them to turn over your account to a collection agency. That would make it a little harder on your credit report for later on.

I recommend getting a phone with caller ID, turning off the ringer, and turning off call screening on your answering machine. You will not hear a thing all day, and you can look at who called every couple of hours or when you get home to see if one was from someone you care to hear from.

I don't think most attorneys send out letters, but have heard of a couple. Again though, I think that's giving the creditors knowledge they don't necessarily need. They will be informed of your BK like when you are filing, that's the law.

Yes, go and "edit" all your posts, and take your name off asap. Who knows who reads these forums.

TEW, I am telling the Original Poster, what our attorney told us to do, and we did so for 17 months--per her instructions.

As for the cyber stalking: if you haven't experienced it, GREAT. But when you have, and can get NO help from any kind of law enforcement agency at all, please pardon me if I feel paranoid. Next, if you DO have a cyber stalker after you, don't think they don't follow every bit of your life and information. It is easier to get information online than you think. Your snarky remark is uncalled for, and not helpful to the Original Poster.

You have been on this forum long enough to know that posters are advised to refer all creditor calls to their attorneys, and to not post any kind of identifying information.

what exactly is a cyberstalker anyway? Just curious, as I've seen HUB post on this several times.
