    Hi there, I just have some questions. Hope someone can help.
    1. Already had my 341 meeting, have a leased car, i'm going to give it up. But I'm already over the miles. when i turn it into the dealership, am i responsible for paying for overage of miles? I'm also behind on payments, they haven't did a relief of motion of stay, or whatever that's called. lol. How long before they come after me.
    Since I want to get rid of it, do i have to turn it in before the discharge papers come? i need to get another car, but the dealers say to wait for discharge papers? confused!!
    2. what is this PACER everyone is talking about?

    I really don't know how long it takes for them to come & get it, but if they don't a motion to lift the stay, they probably can't do anything until the discharge?

    If you're including the account in the BK (and since you're surrendering it, I imagine you are) they can't pursue you for any balance, no matter what reason. BK removes your obligations totally on the debt.

    Regarding getting another vehicle, dealers are probably trying to make sure they don't get caught in the BK. From what I understand-and I may not be right-if you purchase a car now, you could end up ammending your BK to include it and then that financing company is out as a 'used' car is worth less than what they sold the 'new' car for, even if only a month or two goes by.

    Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

      Yes and now that you say that about the dealers waiting til discharge, i do remember hearing that.
