    I had sent my lawyer an email saying we are thinking of giving up the house, not sure yet , or when to start the process, he said this...

    "I reviewed your mail sent to the office. You may decide to give up the house if you so desire. This will not have a negative impact on your bankruptcy. However, please understand that any debt which arises after the date of petition is not included in your bankruptcy discharge."

    does this mean even though house debt is listed in bankruptcy chapter 7, if we miss payments or there is a defieciency if we forclose we are liable?

    anyone have any insight?

    I'm not a lawyer, so don't take this as such, but I think he is saying "any debt which arises after the date of petition is not included in your bankruptcy discharge." Meaning, any debt, not necessarily your house.

    Unless you reaffirm your mortgage, your house will be discharged through the bankruptcy and you will not be liable for any payments or deficiency. Does that make sense?
