    Attorney Question.

    Ok i had my 341 last monday on Dec8th. i called her today to ask a couple questions. Ok she finally called back and as usall i ask the questions and after she gives me some answer im more confused than ever.

    She said 99% of the time in most cases after the 341 meeting she is done very few times some one calls her back for questions.


    Ok does this sound right.unless there is some issue with the trustee im pretty well finished with the lawyer.

      Well, yes and no. In a ch 7 after the 341, it's now a 60 day waiting game and then you're done! You hired your attorney to "represent you" in your BK, so she needs to represent you until you are discharged, regardless if you have questions. Did she answer your questions?

      May 21, 2009 Retained 2nd Attorney
      May 28th - Filed for Ch 7 (FINALLY!)
      9/11/09 - DISCHARGED!!!!

        Our trustee called my lawyer before our 341 and who knows what they talked about. The 341 was over and the lawyer kept saying it was all good. Pacer confirmed with a RND (Report of No Distribution) which is very good. And then the trustee is totally done with you

          Thanks for your Replies. Yes the attorney Called me Back today. And she half way answered the question just like she all ways does.

          It might just be me not catching on but some times after i talked to her i was complety more confused than ever. Honestly i have been 100times more educated Reading this message board than the times ive talkd to her.

            Ok so if there is some problems in the 60 waiting period and the attorney has to get involed does she expect more fees?

              You would have to reread your original contract...I know with my attorney, he represents me for a "basic BK" anything over and beyond like additional court appearances, objections, changes in plan (ch 13) will have addtional fees.

                Liz417.. thanks. Yes i rember now.My packet was stapled together with all the paper work and when i got finished puttin everything together i turned it all in.SO now i dont have the contract but i do rember now that you brougth it up.

                I receved my packet months before i Filed do to some Cash Advnaces i took out so i had to wait 90 days in fact we didnt file for over 100 days.

                        If it makes you feel any better, I haven't seen or heard from my attorney since the day I signed my papers to file. He didn't even come to my 341, he sent somebody else from his law firm. I'm not complaining, as everything is moving along just fine. I think this is just the way they do it on a chapter 7 no assest. Just like the others have stated, if I have additional court appearances, objections etc., I will be charged additional fees.

                          Relief13035.. thanks. that does make me fill better. i thought i had just gotten a bad attorney. but for 1,500 dollars i guess they cant tie up to much time.

                          I rember on the contract she gave me some other additional fees would be like $350 a hour if needed.
