    quick question about surrendering house in chap 7

    im surrendering my house in chapter 7. i included my tax bill that is due on december 31st. i am starting to rent in january and im filing a couple weeks later. can i surrender my house before i file? i already signed a lease and my lawyer said it was cool. but i didnt ask him about when to call mortgage company to let them know.

    my question is though home owners insurance, i normally get the bill in february. do i still pay that? and also when can i stop the gas and electric, because i want to have it transfered to rental right away. im hoping i can cancel gas and electric the day i move out.

    When you surrender your home there is still a process that has to take place through the courts to relieve you of any responsibility that you presently hold as the owner of the property, your Lawyer is the best person to give you advice in such matters but until the deed is out of your name you are still the legal owner with all the relevant responsibilities toward that property. I have found that Google is a great place to find any information that I need about almost anything, so if you need some information just google it.

      I am also surrenduring a house in CH 7. Although I no longer live in the home, I am to still pay for the home owners insurance until the bank takes over. I have shut off my PGE and WATER as advised from my lawyer. Also, I am not to pay the property taxes as per my lawyer. I am still responsible for Homeowners Insurance. Not sure what your lawyer or your circumstances are, just sharing mine.

        i just spoke to mine as well he said cancel gas and electric, just make sure all water is turned off. dont pay property taxes but said i should talk to my hoi company and tell them my situation but keep paying til bank takes over. so basically it sounds like i got same advice as you did. that makes me feel better, thanks for responding
