If we are a no asset case and live with a roommate who pays 100% of expenses, do we need to show pay stubs for the past 6 months for our roommate, just myself or both of us? I have not worked in 1.5 years but my roommate has so he has stubs, not me. I have filed taxes the past 3 years, he has not. Just trying to get a "final" answer on this so I can file tomorrow morning. Thanks a million!

Are you using an atty or going it alone? If you are filing pro se and you are significatly under the median income I wouldn't worry about it, but mention it to your atty if you are using one. That is what I would do.9/03/08...Chapter 7 Filed

That is good advice. I think many of us think we have the "right" answer as we go on how we interpret things, what our attorneys said, etc. However, these "right" answers don't match, so I think the collective we don't know 'for sure' as you ask.
I would talk to your attorney to get advice on your specific district interpretation as well as their experiences specific to YOUR circumstances.

Thank you both. I am filing pro se because we dont have the 1500.00 for a lawyer. I am no asset aside from a few electronics. TV/DVD PLayer and macbook for school. I am just afraid of filing and everything being fine until the 341 if the trustee asks for my roommates taxes for the past X amount of years and I say "sorry don't have em'" since he hasnt filed in like 4 years due to not making enough. I filed anyways last year even though I only made $247.00. If the trustee requests his tax returns and I cant provide them, is my request for discharge denied? I just dont want to screw up my BK and don't want to entangle my roommate anymore than I already have.

Trustee cannot ask for your roommate's tax returns - he/she is not filing - you are. What you have to do is include his/her pay in the "total household income" portion of your paperwork, and somewhere along the line subtract it out - leaving only your income as income.Originally posted by Beeheery View PostThank you both. Again, this is a point of interpretation. My attorney told me to not include the room mates income or expenses in mine and just go on my income and expenses (although both are very small). I asked about this and was told that only including mine was the "right" way.
Just further proof that there are lots of "right" answers on this one floating around.
