    Newbie question

    Hi all:

    I just found your forum today and think it is great. I do not want to waste anyone's time by asking stupid questions so maybe someone can direct me to the archives of this forum where I can do some reading up before I post my story and concerns. Thanks for your help.

          Thanks for your patience. Iwill try to make a long story short (if possible).

          Some time ago my father sued my husband and myself. Because we were moving did not get the paperwork in time to fight it, so a judgment awarded to him. Subsequently, he went on to put a lien on our home (the one we moved from but had not yet sold). When the house would not sell, we put renters in. During this entire time he was accuring interest against us and adding it to our total. His most recent action was against my husband at his work where he attempted to garnish his wages.

          It was at that point we decided to file BK. When met with a lawyer and because our other home had so much equity, we were able to file Chapter 7, which we did in October. We really do not have much credit card debt, no car payments, just the ruthless actions of my father taken on his only child (me).

          We had our 341 yesterday. All went smoothly, as I was told it would, until the end when my father had sent a lawyer to the meeting to question us. The trustee got pissed of at him cuz she was behind but let him ask his questions. He asked questions about our means test. No other creditors showed up. We couldn't speak to our lawyer about this cuz he had 2 more 341s after us and was not in the office today.

          My question is this: Can he make an objection to our debt? If so on what grounds? We did everything by the book and completed all necessary obligatins required by our BK law. I know he is desperate at this point but I do not feel he has anything on us. We borrowed this money from him over 5 years ago under no financial duress.

          Also can anyone tell me what Pacer is and how do I access it?

          Any imput would be appreciate. Again, thank you for your patience.

            I can not imagine anyway he can object to the discharge of the debt. unless he ciaims you committed some type of fraud to obtain this loan it's 5 years old so you'd think he would have done so already. the lien will go away and the debt will be discharged. after that your father will have to start every conversation with you with" this is not and effort to collect a debt"
            there is a sticky at the top of the board for pacer. you can use a debit card and get instent acsess. then use your SS# to find your case.

              Thanks, that is what we were hoping to hear. We are surrendering our first home anyway, so he will get some money but he doesn't have to worry about ever talking to us again.

              Can you tell me what PACER does and where to find it? Thanks again for your time!
