    Almost Ready and Last Minute Questions

    I'm just about ready to print, sign, and send in my petition, schedules, etc. and have a few of last minute questions.

    1. I've been browsing old threads, and I came across this where Original Healer mentions an affidavit for filing Pro Se. Panic Attack! Is this in the form7.com set, and if not-what is it/where is it?



    2. Also-regarding paying the filing fee in installments, is there any standard to how much & how often? Such as, if I offer to pay $109 w/ petition and $50 on Oct. 1, the final $50 by Nov. 1... Will that be ok or do I need to have it paid in full before Oct. 17? Does everything start w/ the 1st payment or the last? Any idea if I can send a check or not? (I didn't see anything about that at my district's home page, though I do know to send 3 copies.)

    3. There has been talk about income taxes possibly being claimed by the trustee... GA allows personal property to $5,000, and if you don't have a home, an additional $5,000 'wild card'. Does anyone think it would be too odd to list a potential refund under the 'wild card'. I only have about $5,500 total in personal belongings, and don't know how much of a refund I'll get next year but I generally get something due to child tax credit. So, would it be too odd to put down $2,500 projected refund? I don't think it will be that much, but I'd certainly be covered.

    Definately call your court clerk with your questions (such as about the installments and what other papers may be required) before mailing. I believe you're filed with your first installment once your petition is accepted. When I called I found out that some things had changed. Like we only needed to send them one copy. We had to send a money order, but ask your clerk.

    We didn't need any affidavit....but we did need to send a ss# form.

    I exempted some tax refunds on my schedule c as wildcard. It's not odd. In fact I had to amend my schedules to include my EIC in order to protect it.

      Well, found some info on the installment bit. It allows that the $209 fee be paid in 3 installments, 1st at least $75 and the 2nd & 3rd due at 30/60 days out, each 1/2 the remaining balance. And, I found that the N. GA court accepts cash or postal money orders, or certified checks.

          Thanks. I'm calling the clerk on my lunch break today with a few questions-and if I haven't found the affidavit by then, perhaps she can tell me where to look...

            Well, I finally found it. Its not like it was obvious or anything though. On the N. GA BK court page, under forms, for GANB local forms-there it is, "Affidavit to accompany petition filed pro se".
