    Will I benefit by waiting a couple months to file?

    Last time I used any CC's was November 29, 2008. I bought appliances (washer/dryer, Frig) so they were substantial purchases. I'm still not delinquent as of yet but will most likely be unable to pay this month's (January 2009) minimums as I need to put cash aside for my BK attorney. My question is this:

    Should I wait until March to file C7 to avoid any hassles by Trustee?

    Also, does anyone know how long it is before the harrassing letters and calls start once you stop paying the CC minimums? And, how bad it is?

    I've never been late on any bill accept a hospital bill.

    Not looking forward to the next few months at all

    You should look forward to starting over and claiming a Chapter 7. Its a nice fresh start, and nothing to get the "blues" about.

    Look at all these big time banks in corporate America, heck look at America itself, bankrupt.

    But here are a few things to keep in mind.

    You should not charge anything within 90 days of filing.

    And, the washer dryer fridge? Did you buy these with a store credit card, or a bank credit card. Sometimes a store credit card has a security interest in them, but I have told not to worry about things like that.

    If your not going to file until March, I wouldn't even worry.

    Also, when they do call, which should be any day now in your case.

    Simply give them your attorneys name and phone number, and dont answer any other questions.

    Thats what everyone does once they retain a law firm to represent them, and after you give them that, they dont really call again until they charge it off and they send it to a collection agency or a junk debt buyer.

    You will be fine, stop worrying.

      Thank you for the kind reply. I keep telling myself not to worry but it's difficult. I have so many things running through my head as I want to time everything right to avoid any problems. Fear of the unknown for sure. I should just be happy I'm not losing a business, going through a divorce/child custody battle...etc all at the same time. Hopefully mine will be a piece of cake.
