    update on my lawyer meeting Re: reaffirmation

    Ok so I met with the paralegal today about reaffirming the car, she really did not want us to do it, and said why tie yourself to $25k worth of debt when in 24 days you will be debt free. She said that she did not think the judge would approve it anyway (showing -750 on sch j) and it would be a waste of our time and money. She also said that if the courts were busy and the judge could not fit us in before our 60 days is up then they could extend the discharge date until the reaffirmation was sorted out ( is that true? as the lawyer himself emailed me and said that would not extend the discharge date) anyway we talked and agreed to change the statment of intent to surrender, and she said just continue to pay (we pay a week early every month) and see if they make efforts to come and get the car, she said she would be amazed if they did with us paying early every month.
    so that's what we intend to do..... I hope it works out ok as I need a car for work, but if they come and take it even with us paying early then what will be will be....

    Its nerve wracking isn't it? This whole reaff/repo thing. If only I knew if the trustee was going to try to take my dh's paid off truck, I'd feel better about not reaffirming my car. I really don't care to be without ANY transportation with a 14 month old and a 2.5 hour move to another part of the state. We have to be out of our house by the middle to end of Feb for the foreclosure.

        Thats the problem TEW. The book value right now is about 1-2k over our 6k exemption for it. However, with the current economy, you can't sell anything around here let alone a ext. cab 1ton diesel with 200+k miles on it. The trustee would sit on it for a looooong time if he did take it based on the book. He said at the 341 he might want an appraisal on that and a trailer we have. We haven't heard anything since and that was dec 9.

        I think you and I are pretty much on the same time frame B65. Let me know if anything else happens with your car. My attny already signed off on the reaff papers. Now we have to decide what to do. We were -1300 on the schedule so I would think our judge wouldn't like that either.

        It still amazes me every day that we were current on everything and paying our bills and even paying extra up until the month we filed. We aren't paying anything now and are still struggling due to job losses. If we can have enough money to move it will be a miracle.
