    Couple ?'s/loan mod and served by AmEx

    We filed a ch 7 last week. Thought it was going to be a 13 until the day before the signing, so that was a NICE surprise. Anyway,,,

    Yesterday my 14 y/o was served by American Express. Nice. His dad and I weren't home. How will this affect things? We already have a case #, so do we just give this paperwork to the atty?

    Also, I am getting a divorce, seems to be going around. I am hoping to stay in my house, but can't afford the payment alone right now. Anyone do a loan mod with BofA? IF so, what types of terms did they offer? The atty recommended I wait until the discharge to stop making the mortgage payments, and then 3 mos into that can start to negotiate with the bank. If I have to let the house go I will, but it's worth trying, this is my boys home. AND I have 3 GIANT dogs that finding a rental with is proving tough.

    First of all that is complete BS that they would serve a 14 year old child papers. I have no idea if its unlawful but I would defaintly search around.

    As far as the divorce I am really sorry you have to go through the stress of that along with all this financial stuff. I hope and wish you all the best.

    Now its the boys home, but can you afford it? Your filing bankruptcy for a reason, and getting a chapter 7 is going to allow you for a clean fresh start! Having a looming mortgage cloud over your head that you cant afford is only going to put you right back in this position. I would highly suggest renting a house and getting out from under it now, that way your protected by the courts from the mortgage company.

    Anyhow, the dog issue is going to be a problem as your finding out. We have 1 dog and Akita and it was really hard finding a place. Not only because he is a larger dog, but because Akita's are on the black list in many places. Luckily I was able to find a house from a private owner that was understanding of our situation and allowed us to do a lease to purchase. Tons of homes are popping up for rent because of the market and I wouldn't give up on the search yet. If you explain what your going through I am sure you will find someone that will work with your situation.

      I think I can afford the mortgage on my own IF it comes down. Right now it's $2K for the 1st and about $750 the 2nd. Sooo,,it would need to come WAY down. I am looking at rents between $1500-$1800. I live in CA, so even rent isn't THAT cheap. I make a good living, I own my own business. I am planning on being able to afford whatever I do without considering the child support, which could be anywhere from $1200-$1500 based on his income. But I want to be able to do it without that FIRST.

      I have 3 Great Danes, which are on some black lists too. WHATEVER, talk about gentle giants! And the divorce is incrediby sad, I don't want it, but I can't make it work on my own, believe me I've tried. Soo,,,here I go through the most difficult time of my life alone.

        Not a relevant reply, but love your doggies!

        Nice to see you didn't crop their ears, I love the natural look and owners that don't mutilate for appearance.
        We have a breed that typically has a cropped tail but opted for the wagging, personality showing long variety.

        I found a house that accepts pets, , my best advice is start looking early, LLs that accept pets are kind of hard to find, but if you offer them a decent pet deposit, they usually agree to let you rent.

        Kind a hard to "hide" 3 great danes from a LL!

        Or... you could dress them up like kids and tell them they are your triplet children.

        Just kidding, best of luck to you. You will find a place for the pooches, there are animal friendly LL out there.

          Thank you, love my dawgs too, and with the pending divorce will be needing them more than ever. I have found a couple places that will let me have them, private owners, but petsitting is the nature of my business and I also board dogs in my home. So I would REALLY like to stay here so I can continue doing that, it's a BIG chunk of income to lose, and I couldn't risk doing it in a rental. But, whatever will be will be,,,,sooo,,,,,

          I like the natural ears too, big ol floppies.
