    List of Creditors

    I filed chapter 7 and was discharged in Jan. 04. I am just getting copies of my credit report. Trans Union has stated that I need to send them a copy of the discharge papers and the list of creditors in order to dispute those I regarded to as included in Bankruptcy.

    I had a problem with one of my creditors before, them telling me that if they were not included in the list, I am not discharged of their debt and they were not included.

    My lawyer, however, stated to me, that although that is true in say California, in the state of Illinois, regardless of whether or not you physically listed the creditor, once your BK is discharged, you are discharged of all dischargeable debts. He also stated that in the state of Illinois, you cannot pick and choose who is included and who is not. Your bankruptcy includes all creditors.

    After explaining this to that creditor, and refaxing my discharge papers, they relieved me of that debt.

    How true is what my lawyer said (for those knowing Illinois law as to compared to other states)? And if this is true, will I be able to fight this same case with Trans Union and the other two CRA's for that matter?

    your lawyer is correct. When I cleaned up my credit report, they ask for copies of my discharge papers and everything was changed to IIB, zero balance, which is what you want to get your score up. You only send in the discharge paper, not the credior matrix.

      so just the letter that says...

      so wait, we only send in the letter that says your name and address and the the whole IT IS ORDERED: The debtor is granted a discharge under section 727, yadda, yadda letter?? Not the the whole listing of people you owe? Cause that is a huge list.

        Is that true in all states (since it's US Bankruptcy Code) or is it only in some states?
