    And the countdown begins, just had 341 Meeting

    Okay everyone....breath!!

    Just had my 341 meeting on Wednesday and figured I would post what happened. A little background, I filed chapter 7 on August 4, 2005, and have a no asset case. On September 14, 2005, just this past Wednesday went to the 341 Meeting. The worst part about it was waiting around for my name to be called.

    -We got there about 10 minutes before it was scheduled to begin. It was held in this little back room of the federal courthouse, no judge, just the trustee up front at a desk and about 10 rows of chairs where we all set down. About 1/4 of the people in the room were pro se, the rest had lawyers. I think the pro se people seemed to fair better, less questions than the people with lawyers which I thought was odd.

    -I was called 8th, each one prior to me lasted about five minutes if that. Even the asset cases i saw. A couple stories that were quite interesting though. The first is a lady was called and she filed to stop foreclosure on her home. Well, the trustee asked her for paperwork that he requested she bring, she didn't have it, he requested information on her home, she didn't have it, mind you she had no lawyer. He said he would continue the case pending she bring the remaining paperwork he requested. She also kept asking him questions, thats a definate no-no it seemed as he was getting very irritated. He kept telling her stick to yes and no answers unless asked to elaborate. Second case that I thought very interesting was a couple who repeatedly had been filing bankruptcy and then not showing up to court, the trustee actually went on record and announced to the room that the case was going to be dismissed with prejudice because they were frivoulous cases.

    -Anyway, when I was called I was sure that creditors were going to jump out of the ceilings and eat me alive, but no one showed up, and actually no one showed up for anyone's case at all. I went up there and the questions were pretty much the same as everyone prior to me except as I said before, pro ser's seemed to have less questions than those with lawyers. These are the ones I can remember him asking:

    1. Are you familiar with all the information in your paperwork?
    2. Did you sign the paperwork, is that your signature?
    3. Do you own any property in this state, or in the U.S., or outside the U.S?
    4. Am I a relative of my landlord?
    5. Am I suing anyone?
    6. Have I paid any of my creditor's more than $600 in the last three months? (This one stumped me because yes I have paid my car payment more than 600 in the last 3 months, so I said yes, and then had to explain my car payment, he said no he meant unsecured creditors, so I said no)
    7. Am I holding property for anyone else?
    8. Is anyone holding property for me?
    9. Have I transferred any property to anyone to avoid disclosure in the last 12 months?
    10. Have I listed all my assets and debts on my schedules?


    That was about all the questions I can remember, and then he said good luck!

    *Checked Pacer this morning and it said no distribution, the trustee requests discharge of debt.

    Another note, I filed pro se, no lawyer etc.. and everything went very smoothly! 11/14/2005 is the date the creditors have until discharge!!!!! So now just waiting it out.

    Then I will have about $15,000.00 in CC debt gone but will still have reaffirmed my car loan, and of course have my student loans. Although with my student loans, Sallie Mae gave me a year forebearance to get my finances in order because I filed bankruptcy. I just called them up and told them that I had filed, and they said oh well you don't have to make your payments until after discharge, and they said if I wanted to I could request a forebearance based on the bankruptcy.

    I am so glad that was over, not difficult at all, and all that sweating and nausea for nothing!

    Sounds good! Hope no creditors object and you are discharged without any problems!!!

      Maybe a prescription for phenergan should be written while you are waiting on the 341 meetings. Just a little joke to liven things up. I am sure we all were/are nauseous.
      I'll be watching, you may never know when or how, but I'll be there. I am there now....

        Sounds great. We had the same experience. 341 on 9/16. We are on about the same track so I am totally with ya. Good Luck. TDP

          What happens if you paid more? I paid until I ran out of money and will file by the deadline.
