    Feeling desperate

    I just got a call from my attorney's assistant that if I'm not going to sign the reaffirmation today I need to turn my car in. I had every intention of reaffirming but I can't because I'm still a month behind on my payment with no hope of catching up by tomorrow. I was coming to grips with the reality of the possibility that I may have to turn in my car but now that it's here, I feel desperate and ready to give up. I have no way to get to work (no bus service where I live) & giving up my car means losing my job. I feel like theres no point in even trying anymore and the attorney's office is so heartless and rude when I dare to ask questions so that I can try to understand this whole process. I just dont know where to turn or what else to do, they've taken my income tax money so no hope now of catching up or paying for a new place to live so whats the point????

    Well take this time before they repo the car you can't afford to find another. reduce the amount they are taking out of you pay each week so you have more money to live on each month. If you are getting a tax refund that means you are sending more money to the IRS then you need to.

      bknflorida, we have all felt as you do now. If you wish to keep the car, reaffirm the papers anyway, attempt to make a 1/2 payment in two weeks and the other half in the next two weeks. Call the car mortgage company and explain that you will reaffirm IF they go along with your catching up. They don't want your car. They want the money. If they don't cooperate state you have no choice but to have them pick it up. They will eventually come around. 'Hub

        That's what I want to do but I don't want to throw money away either. My attorney's office is saying that Toyota is only saying that I don't have to turn my car in because they want money & they'll get me to make my payments to get them caught up then they'll either refuse to sign the agreement after that or the court won't sign because I'm not current. I don't know what to do! My attorney's secretary was rather nasty to me on the phone she said "fine sign it, we'll turn it in and see what happens". My concern is that if I do keep paying and they refuse to reaffirm will they then be able to take the car back anyway & charge me for over mileage, the difference between what they sell it for & what I owe, etc? I'm afraid to ask my attorney these questions because I hate being spoken to like I'm a moron or treated like I'm wasting their time!

          I would call the attorney's office and not so gently remind the RUDE secretary that they work FOR YOU. You are allowed to be a moron concerning BK, because you didn't go to law school. They have been paid to perform a service for you and rudeness is inexcusable. You wouldn't allow a minimum wage McDonald's employee to be rude when you're going to spend a dollar on a hamburger, don't allow this b***h to do it either!

              It's a lease. And to GreenonPaper, I agree 150%. I did ask her finally if she was that rude to everyone or if it was just me & she finally changed her attitude but I still got a snotty response instead of actually answering what my options are. I finally did decide to sign the reaffirmation & hope that the court will sign it even if I'm not caught up by the time it gets to them. If not, at least I bought myself a little more time before I have to turn it in. I'll be moving the end of the month & will be less than 5 minutes from work & there's buses, right now no bus & I'm about a 1/2 hour away.

              I'm so lost in all of this, thank God for this board & all the wonderful advise!!

                Is Toyota asking you to reaffirm because you are behind in payments or just in general?
