    Form Question - for a BK lawyer

    I had my forms prepared by the on-line service Bridgport Bk - there are a lot of errors - will the court accept forms that have been corrected (i.e. whiteout)? I use to work for the courts years ago and took many busines classes....back in the day you could not use white out or make corrections, things had to be "perfect". Is it still that way? I may just have to fill all the forms out again....or, if I can make corrections - it will be much easier. I do want the forms to go in right though.

    u should call the court clerk and see what they say,all courts are different

      This reminds me of a story my mom told me about her 341 yesterday.

      A lady was there, she's married, filing alone. (this did NOT make the trustee happy). She did NOT claim any of her husbands income, nor did she claim any of "their" assets. They have been married 8 years, and the trustee kept questioning her on this.

      I kept telling my mom, it's legal. She doesn't have to file with her husband. Like me, *duh* I have ALL the cards in MY name. I could have filed without my husband. I have USED all the cards, he hasn't charged one thing, doesn't even like me having them! (but I am on the house, so that would have been an asset!).

      Anyway, apparently this lady had tried to file last year, something was wrong, so it was dismissed. BUT, she took the same papers BACK this year (which I find VERY odd, I thought you had to wait 6 years??) but they were last years papers, with whiteout and corrections just written in.

      The whole thing didn't make the trustee very happy, but he had no choice but to stamp her and say, "OK". Oh, if I remember correctly, she was late too. She was not in my moms "group". But half way through the hearings, the trustee found out the court was sending people to the wrong room! So I think that's why this lady was late. But she was a pro ser too. But I guess it doesn't matter if the trustee is happy or not, he can't deny your bk just because he's not happy with you.. ;)

        He can't deny you - but he sure can make your life miserable for a while if he wants too...................

        My Trustee has been "dragging his feet" for 15 months now on me.................. he's in no hurry (and right now he's probably SO BUSY WITH 341's he can't see straight).
        After 11 months the Judge even questioned why the case had not been closed yet, and the trustee filed a petition saying we were in negotiations.....

        Negotiations - hell, nothings been done for 15 months now..... what negotiations??? We reached an agreement on everything - they just won't take time to stop, accept money, and re-do titles and deeds.

        Of course I have been discharged from everything else for almost a year now..... just the house issue to settle...

        WISH THEY WOULD DO SOMETHING - I'M SOOOOOO TIRED OF IT ALL...... NOT KNOWING WHAT'S GOING TO HAPPEN.... "ROOF OVER MY HEAD - OR NOT"?????

        SORRY, didn't mean to take over thread and "sound off"..... frustrating!!!!!

          Sorry Teri, didn't mean to sound off on your thread.....

          As far as the forms, I would re-do those forms and submit them "looking good"...... too many changes in figures might raise a red flag - for the Trustee too "look into things".....

          Just a thought,

          There are some forms you can download listed on this forum that you can use that could be filled out rather quickly since you have the info already.

          Let us know what you do,

            The 6 year rule (soon to be 8) involved successful discharges. If hers was dismissed, that is different. I *think* there needs to be 180 days between filings, but I'm not positive. (I've read where some people regularly file BK to get the automatic stay protection, don't go thru w/ anything - so it gets dismissed - and they file again once they're allowed to...)

            Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

              I downloaded the forms from my states web site - and also used the free portion for form7.com - I whited out a lot of the bad information that Bridgeport put on my forms and made a new copy of the form - they look like new, I will type (if I can find a typewriter) correct information and submit, hopefully by next Tuesday. If anyone ever asks - Bridgeport Bankrupcy does not give you professional looking forms - and their add is a flat out lie! From what I am seeing on form7.com for $39 you get more help than the $189 I spent with Bridgeport.
