    More info prior post on objections

    Hi everyone,

    On my pacer it shows an objections due 1/26/09 then shows an event filed on 1/21 for objections due 2/20. Is this an extension? If so why? I haven't received anything in the mail or heard from my attorney.

    341: 11/25/08
    objection to certain debts: 1/26/08
    objection to discharge due: 1/26/09
    objections due: 2/20/09 (filed 1/21/09)


    Okay so I found an explaination to the above objections due. The trustee signed off but I still have to wait for any objections to the discharge.

    From Pacer
    Trustee hereby abandons all property of the estate set forth on Schedules A and B as burdensome or of inconsequential value to the estate. 11 U.S.C. 554. Pursuant to FRBP 5009, trustee certifies that the estate of the debtor(s)has been fully administered. Trustee requests that this report be approved and that he/she be discharged from any further duties as Trustee. Objections due by 2/20/2009.

    ok so does that mean discharged?

    or discharge is coming anyday?

      Your trustee has asked to be released from your case - that's good news. However, whatever was filed on 1/21 allowed your creditors until 2/20/09 to object to your discharge. Any idea what was filed on 1/21? Your lawyer should know if you ask. Chances are it was nothing of consequence - that's why you haven't heard anything. But best to make certain.

      Since your creditors have been given until 2/20/09 to object to your discharge, your Ch 7 won't be discharged and closed until after February 20 passes.

      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go

        I always thought

        that if a creditor objected it had nothing to do with the rest of the bankruptcy and discharge went ahead but not the debt in question... that could be settled or not later...am I wrong?

          I am confused

          Copied this from sticky above....

          "These factors DO NOT effect the discharge date

          1. A creditor objection. When a creditor objects to discharge, they are objecting to the discharge of THEIR particular debt. Doing so has NO effect on the date of your discharge.

          2. Designating your case an ASSET case. The fact that the trustee designates your case as an ASSET case has no bearing on when you receive discharge. The designation of your case as an ASSET case generally has the effect of extending the time before your case "closes", but you should still be discharged on time. See this thread http://www.bkforum.com/showthread.php?t=10879 regarding the difference between discharge and closing. "
