    Strange Tax Situation

    I filed a No Asset Chapter 7 in December. I owe the IRS about $950 which I know can't be discharged (2007 tax year). However, I filed my return this year, $1300 return, I figured the IRS would take their cut and I also thought the trustee might take it.

    Not a word from either one of them. Tax return direct deposited!!! 2009 is looking like a good year from here!!!

    But you still owe the IRS $950 and you need to advise your attorney of the amount of your refund. Not all trustees receive refunds direct from the IRS and you may have to turn it over directly.

      The attorney provided the trustee with my 2008 tax return prior to the 341. I know because the trustee handed the tax return to me at the 341 and asked me if I'd be getting a Georgia tax return as well, which I won't. Others that went before this man he asked how much of a return they were expecting and would explain that it was an asset, etc., etc. Mine, he just looked at it, was a bit impressed that I'd already filed my 2008 and handed it back to me.

      Pacer shows it to have been declared non-asset.
