    Should I list my husband's info?

    I am filing alone in CA (a CP state). Well my question is should I list my husband's bank account? Rent, gas and electric deposits even if they are all under his name?? He also has a car under his name, should i list that as well?

    Any help will be greatly appreciated...Getting ready to file thanks to all you helpers out there.

    Are you and your husband still living together?

    You do realize that even if you successfully discharge a bk then all the creditors can come after your spouse for them in a community property state.

    Yes even if in his name they are marital assets and debts. You would list utilities only if you are behind in paying them though. You would need to exempt your share of the car though in order for him to keep it.

    You both probably should see a lawyer or two and discuss your options with them. In some CP states it depends when assets were gained, length of marriage, etc.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      Yeah we are still together....so I should probably list the deposits which are under his name....also his bank account. Thanks again.
