    default judgement

    I was going to file BK soon but I was just served a citation this morning. Now I have to deal with a possible, or probable, default judgement. I will most likely be getting a couple more in the near future. I have had no income for more than a year and can't afford an attorney. All my debt is CC and I have no assets. Should I let all the impending judgements be handed down and then file BK or should I start the process now? Will a Ch7 lift one or more judgements? If I answer this citation to appear, all I can tell the judge is that I have no money or income and can't pay. If I don't appear, I will most certainly be given the stiffest penalty. Does it really matter if I appear or not? Either way, I just can't pay, and with no income it's hard to make payment arraingments. Thanks in advance for all replys.

    Whether you appear or not, the judgement will most likely be awarded as you owe the money. A BK will erase the debt that caused the judgement but the judgement will have to be "vacated" in a separate motion to the court. If you don't want all that on your credit report, it is probably better to try and file prior to the judgement being awarded. Perhaps there is a legal aid group in your area that would be willing to help you fill out the paperwork required. Good luck!

      Go to the library and ask for self help books on filing a chapter 7 bankruptcy. Most of the books come with forms and everything, and are VERY self-explanatory. Most courts will then let you make payments if you really can't afford to do it otherwise!
